No longer required to prove conformity from first principles where a harmonised standard covers the requirement: conformity is presumed, and Art. 37 adds a Commission common-specification fallback where no standard exists or the standard is inadequate.

Packaging and Packaging Waste RegulationArts. 36(1)-(3) and 37Economic operators demonstrating conformity of packagingBusinesses
Prior rule
Trigger

packaging complying with relevant harmonised standards, or with national standards where no harmonised standard existed

Obligation

Member States presumed compliance with the essential requirements in Annex II for packaging complying with relevant harmonised standards published in the Official Journal, or with notified national standards in areas where no harmonised standard existed.

New rule
Trigger

packaging conforming to a harmonised standard or a Commission common specification

Obligation

Conformity is presumed against the whole of Arts. 5 to 12, 24 and 26 -- a far wider requirement set than the old Annex II essential requirements -- and Art. 36(2) additionally presumes conformity for methods performed by accredited conformity assessment bodies. Where no harmonised standard exists or an existing one is inadequate, Art. 37 lets the Commission adopt common specifications that carry the same presumption.

Verbatim

Packaging which is in conformity with harmonised standards or parts thereof, the references of which have been published in the Official Journal of the European Union, shall be presumed to be in conformity with the requirements laid down in or pursuant to Articles 5 to 12, 24 and 26 covered by those standards or parts thereof.

All three counts are taken across every row of all seven register files, attributing a row to a sector where the slug appears in sectors_named or sectors_reached. 74: rows touching chem/plastics whose derived valence is Requirement, Prohibition, Support cut or Entitlement withdrawn. All 74 sit in data/ppwr.json; no other register file carries a duty-side row for the sector. MIN-01, RCY-01 and BAN-01 are cited from that set as the minimisation duty, the recycled-content minimums and the Annex V format prohibitions. Zero: no row typed 'incentive' anywhere in the register carries chem/plastics in sectors_named or sectors_reached, and no row touching the sector derives the valence Opportunity. The sector's entire favourable side is the five further cited rows -- FREE-03, REC-05, LAB-04, CNF-02 and EPR-04 -- three transitional or mutual-recognition rights, one conformity simplification and one procedural right. None of them moves an amount, a rate, an eligibility or the existence of any funding, which is what the incentive type requires; that is the sense in which the count is zero. Three further PPWR rows carry direction 'unchanged' and are counted on neither side. 30: rows typed 'incentive' anywhere in the register that carry at least one slug in sectors_named or sectors_reached -- iaa 16, ets 9, nzia 3, crma 2. Of the register's 39 incentive rows, 9 attach to no sector at all. The same 30 rows are returned by the stricter test of derived valence Opportunity, because the one incentive row typed as a Support cut is among the 9 that name and reach no sector. None of the 30 touches chem/plastics.
